Terms and Conditions

‍These Terms and Conditions ("Terms") constitute a legally binding agreement between Web Genie ("Company," "we," "us," or "our") and the customer ("you," "your," or "Client") for the provision of website development and website design related services. Please carefully read these Terms before engaging our services. By making the initial payment, you signify your acceptance of these Terms.

1. Contract Initiation
1.1. These Terms will come into effect upon receipt of the initial payment as specified on the checkout page provided by Web Genie.
1.2. A 30-day cancellation notice is required to terminate the contract. If you decide to cancel our services, you must provide written notice to us at least 30 days before the desired termination date.

2. Services
2.1. Web Genie agrees to provide website development and website design services. The scope of work and any subsequent changes will be documented in a separate project project portal.
2.2. Work will only commence once the Client completes the onboarding form, providing all necessary information, materials, and approvals.
2.3. The Client is responsible for providing accurate, complete, and timely information and materials required for the project. Delays in providing these may impact project timelines.

3. Payment
3.1. The Client agrees to pay Web Genie the fees and costs outlined on the checkout page. Payment terms will be as specified on the checkout page. Failure to make payments may result in a delay in project commencement or termination of services.
3.2. Any additional services or changes requested by the Client outside the initial scope of work will be billed separately and agreed upon in writing.

4. Project Timelines
4.1. Web Genie will provide estimated project timelines based on the scope of work and the Client's responsiveness in providing necessary information. We will make reasonable efforts to meet these timelines, but delays may occur due to unforeseen circumstances.
4.2. The Client understands and accepts that website development timelines may be impacted by factors beyond our control, such as third-party service providers, technical issues, or force of nature events.

5. Intellectual Property
5.1. Upon full payment of all fees, the Client will own the rights to the developed website, including the source code. Until payment is made in full, Web Genie retains ownership of the work-in-progress and source code.
5.2. Web Genie may use the completed project as part of our portfolio and marketing materials.

6. Privacy and Data Security
6.1. Both parties agree to comply with all applicable data protection and privacy laws. The Client is responsible for the content and data they provide and how it is handled on the website.

7. Termination
7.1. The Client may terminate this contract by providing written notice at least 30 days in advance either by written mail or email.
7.2. Web Genie may terminate this contract if the Client fails to make payment as agreed or breaches any other significant term of this agreement.

8. Confidentiality
8.1. Both parties agree to keep confidential any sensitive or proprietary information shared during the course of the project.

9. Warranty
9.1. Web Genie warrants that the website will be free from defects in workmanship and materials from the best of their abilities.

10. Limitation of Liability
10.1. In no event shall Web Genie be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, revenue, data, or use, arising from or related to our services.

11. Governing Law
11.1. These Terms and any disputes arising from or related to our services will be governed by and construed in accordance with the laws of the state of Arkansas.

12. Entire Agreement
12.1. These Terms represent the entire agreement between the parties and supersede all prior agreements or understandings, whether written or oral.
